Restricted Businesses

Prohibited from use of any Zai Payments Services

Zai does not provide services to the following categories of businesses and business practices (“Restricted Businesses”). These restrictions may be imposed by our financial service providers partners, credit card networks, acquiring banks, and other financial institutions and authorities. By registering for a merchant account with Zai, you confirm that you will not use the our service for any activities that violate any law, statute, ordinance, or regulation and/or in connection with the following businesses, business activities or business practices:

• Domestic/Foreign unregistered Charities
• Shell Banks
• Unlicensed Financial Advisors
• Unnecessarily complex ownership structures (e.g. nominee or Bearer share corporations)
• Products & services invoking or supporting racism, violence, abuse discrimination, hatred, terrorism, paedophilia or other immoral activity
• Counterfeit/Imitation items but not limited to currency, coins, stamps, counterfeiting equipment, trademark infringement items, goods infringing on 3rd party intellectual property rights
• Other categories of which we may notify you about

Restricted Industries

Prohibited from use of any Zai Payments Services

• Criminal and Illicit Activity
  Criminal organisations or members associated with such in any capacity;
  
  Engaging or facilitating in criminal activities (including tax evasion offences for themselves or as agents); 
  
  Products designed to circumvent copyright protection techniques or to otherwise facilitate the unlicensed use of copyrighted materials (e.g. ‘mod-chips’ to break the encryption of game computers to enable the playing of unlicensed copies of games);
  
  Illegal products or services or any service providing peripheral support of illegal activities. Counterfeit goods/replicas or those infringing on intellectual property rights, including those designed to infringe on such intellectual property (i.e. knock-offs, imitations, bootlegs);
  
  Stolen goods or fraudulent goods as identified by the law of that jurisdiction;
  
  Fake references and other services/products that foster deception (including fake IDs and government documents).
  
  
• Illicit and Recreational Drugs
  Illegal drugs, and tools specifically intended for the unlicensed production of drugs, drug paraphernalia, substances designed to mimic illegal drugs, and/or other psycho active products(e.g.,K2, salvia divinorum, nitrate inhalers, synthetic cannabis, herbal smoking blends, herbal incense, and HCG/HGH-like substances).
  
  Prescription drugs and devices in violation of applicable laws or industry regulations.
  
  Products/services specifically offered or intended to be used to create drugs or grow ingredients for drugs in violation of applicable laws or industry regulations (e.g. ‘grow shop’ products, seeds for cannabis plants, etc.)
  
• Certain Unregulated Finance
  Timeshare and timeshare maintenance.
  
  Pyramid selling, multi-level marketing.
  Cash carriers/couriers.
  Real estate agencies involved in large cash transactions (e.g. cash property purchases).
  
  
• Trust & Corporate Service Providers 
  Trust service providers. 
  Corporate service providers (i.e. providing company incorporation or registration services).
  
  
• Government and Political 
  Government owned/controlled entities operating in a foreign country (i.e. the entity is owned by a different government to that of the country in where it operates);
  
  Political organisations.
  
  
• Adult Content / Services 
  Pornographic book/video/toy stores or fetish products;
  
  Any websites or products on the internet containing graphic/nude content or audio (phone sex and adult phone conversations), video (web-based sexually oriented video);
  
  Companion/escort services or sexually oriented dating services; 
  
  Escort agencies / massage parlours / sexual services / Prostitution;
  
  Topless bars, and strip clubs;
  
  Mail order spouse and international match-making services.
  
  
• Military or Defence related 
  Trade of weapons (including parts), ammunitions, military arms, explosive devices;
  
  Mercenary or contract soldiering.
  Any supplying goods or services of a primarily military relevance.
  
  
• Betting, Gambling and Gaming 
  Providing betting and gambling services.
  
  Direct purchase of wagers/chips via payment card.
  
  Games of skill where participants receive cash or cash equivalents or prizes with/of material value. (e.g. electronics, travel, gift cards, etc.)
  
  Lotteries, including online lotteries.
  
  And other lotteries or gaming as defined in the Gaming and Lotteries Laws in the relevant jurisdictions. 
  
  Sports forecasting or odds making.
  
  Internet gambling.
  
  Fantasy sports leagues where participants receive cash or cash-equivalents or prizes with/of material value. (e.g. electronics, travel, gift cards etc.)
  
  
• Telemarketing & Deceptive Marketing Practices 
  Telemarking companies involved with the following methods of operations: Offering a free gift, prize, or sweepstakes/contest entry as an inducement to purchase their product or service; Inbound telemarketing companies that receive calls as the result of post cards or similar mailings (as opposed to catalogue or media advertising); Selling products/services as an agent for a third party;
  
  Merchants engaged in any form of deceptive marketing practice including but not limited to: Hidden Disclosure; Bogus claims & endorsements; Pre-checked opt in boxes; Refund/Cancellation avoidance; Poorly disclosed negative options; Merchants offering substantial rebates or special incentives (e.g., free gift, prize, sweepstakes, or contest) as an inducement to purchase products/services; Negative response marketing techniques by any type of merchant (i.e., customer is automatically charged if they don’t return the merchandise at the end of a free trial period).
  
  Social media “click farms” (i.e., the sale of clicks/likes/reviews/endorsements on social media sites).
  
  
• Sanctions
  Is a Sanctioned Party or is owned, 50% or more individually or in the aggregate, by a Sanctioned Party or Parties.
  
  Any individual permanently resident in a Sanctioned Country or Territory.
  
  Any entity registered, incorporated or having its principal place of business in a Sanctioned Country or Territory (including any office, affiliate, branch or subsidiary it owns or controls, whether inside or outside of a Sanctioned Country or Territory).
  
  
• Shell Companies established for Illicit Purposes 
  True identity of customer or its UBO cannot be determined;
  
  There are doubts about the veracity of documents or information obtained for the purpose of verification; 
  
  The purpose or nature of relationship cannot be established or appears to be illegitimate.
  
  
• Bearer Shares 
  Companies for which 'bearer shares' have been issued.
  
  
• Diamonds and Precious Stones & Metals
  Rough diamond dealers who are not compliant with the Kimberley Process;
  
  Other precious stones and metals dealers;
  
• Human & Animal Rights
  Products/services that promote hate, violence, discrimination, terrorism, harassment or abuse;
  
  Trade in human or animal organs, including blood and plasma;
  
  Trade in wild or endangered animals (elephants, pangolins, rhinos, sharks);
  
  Abuse of Animals, vivisection or the use of animals for any unauthorised scientific purpose; 
  
  Abuse of refugee or human rights.
